Court Hearings

In any family law cases, there are various common types of court hearings in the court system.  This blog highlights the general process a case will go through.

  1. Initial Case management Conference (ICMC Hearing). This is the first hearing before the court where the Judge will discuss with the parties about the various options their case can do through.  Here, the Judge encourages mediation or other alternative Dispute Resolution.

  2. Motion Hearing. Motion hearings are to help resolve an issue like temporary parenting time, financial support during the process, etc.  These hearings are quite expensive and can make a case more difficult, but they are necessary in certain situations.

  3. Pretrial Hearings. At this hearing, you will be negotiating and working on trying to resolve your case.  If you are unable to do so, the Judge generally will set a trial date and discuss trial deadlines, etc.

  4. This is when all else has failed and you need to have the Judge decide your issues within the case.  Trials can be a few hours to a few days or longer.  Generally, the goal is to not end up here.
